Dear Members,
 
Many of you have had questions regarding the recent increase in operations/maintenance fees and the special assessment.  Our and Oombaga's telephone line have been very busy addressing your concerns.  To eliminate duplication and to more efficiently get information out to you we put together the following list of most frequently asked questions and answers.

  1. Can the Resort collect from me if I do not pay?
 
The Virgin Islands Department of Licensing and Consumer Affairs restricted certain avenues of collection but not collections in general. There is no general prohibition on the collection of past due accounts. And we are hopeful that the restrictions will be lifted shortly. The Resort has other debt collection methods available to it, so it is important that members fulfill their contractual obligations.

  1. What if I cannot afford to or do not want to continue my membership?
 
For those members who wish to surrender their membership please contact Viola Morton. For members in good standing the termination fee is $3800.00 on or before May 15, 2017 and $4500.00 after. Viola has more details. We will be happy to discuss a payment plan for the membership exit fees.

  1. Can I see a list of the Resort’s creditors?
 
Certain debts and delinquencies of the Resort are a matter of public record. We are fortunate that many of the Resort’s creditors are willing to work with the Resort in allowing the Resort to make payments. We do not want to jeopardize these relationships. However, a sampling of the debts and delinquencies include taxes in the amount of $1,000,000+ and $600,000 + in other debts.  Of note, we are making payments of the back taxes a priority in the recovery efforts.

  1. I am a member in good standing, what is being done to protect me?
 
We understand the frustrations of our members in good standing who are being burdened by the members who are delinquent. We are diligently working on adding the delinquent member’s room into the Resort’s hotel stock. We hope that this revenue stream will alleviate the burden on the members in good standing. Rest assured that the members who are not in good standing are not permitted use of their weeks at the Resort.

  1. Are the Developer/Operators, Michael and Mercedes Shelby, profiting off the Resort?
 
No. They have maxed out their personal credit cards and personal credit lines, depleted their savings and retirement funds, sold personal assets to generate money to pay resort bills and improve the Resort.  They have only taken a minimal salary for years while at the same time increasing their personal liability for unpaid corporate fiduciary taxes.  All revenues generated by the resort has been allocated to resort operations and  maintenance.

  1. I have questions and concerns, what should I do?
 
Members are invited to contact Viola Morton, Lori Baskin or Michael Shelby if they have any specific concerns about the Resort. We also invite suggestions from the membership for solutions to the economic set back. Legal challenges and consumer complaints have only added to the Resort’s challenges and not aided in the recovery.
  1. Has the resort made any recent improvements?
 
Since 2010 the following is a list of improvements at the Resort:

  • Repaired and re-coated roofs on all buildings
  • Completed lower pool deck and added events area
  • Constructed and equipped new gym
  • Constructed two private bathroom/showers for club members
  • Repaired and upgraded resort electrical system
  • Repaired and repainted building exterior                                                  
  • Repaired and replaced all exterior decks and steps in buildings
  • Repaired and refinished tennis courts
  • Repaired, re-tiled and painted inside all units
  • Renovated and re-tiled all offices and lobby
  • Installed cyclone fence lower pool deck area
  • Installed new hot water plumbing system in the TLC Bay Building.
  • Rebuilt and reconditioned resort diesel generator power system 
  • Constructed new generator pad, wiring and switch in lower MBV parking area.
  • Installed solar water heating system for 2 Jacuzzi’s.
  • Refinished lower pool and installed energy saving pool pump.
  • Completed tiling of bathrooms in TLC and MBV buildings
  • Updated majority of furniture in TLC and MBV buildings.
